Content-based image retrieval (CBIR) is a technique used to retrieve image from an image database. However, the CBIR process suffers from less accuracy to retrieve many images from an extensive image database and prove the privacy of images. The aim of this article is to address the issues of accuracy utilizing deep learning techniques such as the CNN method. Also, it provides the necessary privacy for images using fully homomorphic encryption methods by Cheon–Kim–Kim–Song (CKKS). The system has been proposed, namely (...) RCNN_CKKS, which includes two parts. The first part (offline processing) extracts automated high-level features based on a flatting layer in a convolutional neural network (CNN) and then stores these features in a new dataset. In the second part (online processing), the client sends the encrypted image to the server, which depends on the CNN model trained to extract features of the sent image. Next, the extracted features are compared with the stored features using a Hamming distance method to retrieve all similar images. Finally, the server encrypts all retrieved images and sends them to the client. Deep-learning results on plain images were 97.87% for classification and 98.94% for retriever images. At the same time, the NIST test was used to check the security of CKKS when applied to Canadian Institute for Advanced Research (CIFAR-10) dataset. Through these results, researchers conclude that deep learning is an effective method for image retrieval and that a CKKS method is appropriate for image privacy protection. (shrink)

In the era Islam emerged, Arabs were calling Jews and Christians as Ahl al-Kitāb, respecting them and affected by them in many ways. When they failed in their debates against the Prophet, they were referring to the scholars of Ahl al-Kitāb and relying on the information they got from them, they were trying to force and beat the Prophet intellectually by their questions. In the Meccan period, no clashes had happened between the Muslims and Ahl al-Kitāb. Jewish scholars had been (...) admitting that they knew the similarity in the topics of Qurʾān and Tawrāt, the Qurʾān were telling the truth and the Prophet was conveying the message of the truth. In some of the verses, these right attitudes of the scholars of Ahl al-Kitāb are used as a reference against Mus̲h̲riks. In the verses said, those scholars are praised and indicated as a source of information for the Prophet as well. The verses related with the topic were understood in parallel with the context and direct meaning of the Nass by some scholars, yet, they were explained not taking the Nuzul environment and process into consideration by some other scholars. It is mentioned that ʿAbdallāh b. Salām and his friends who became Muslims in Medina period have been told in these verses. In this study, level of validity for these interpretations will be evaluated based on Qurʾān –relationship and the fact that some of the asbab al-nuzul (circumstances of revelation) are known to be jurisprudential; and it will be argued that the true meaning of the naṣṣ is overshadowed.Summary: Tafsir is an effort to understand the divine address, and also to understand the relationship between Muslim, polytheist, and People of the Book (Ahl al-kitāb) in the revelation and experience in this context. Since these issues are not explained in a wide and clear manner in the Qur’ān, the hadīths, prophetic biography, narratives of asbâb al-nuzul and the opinions of the companions and the views of the Companions and Tābi‘īn gain importance in understanding the verses. As the narrations of asbâb al-nuzul contain some problems, it is proposed to evaluate this information based on sigas and hadīth method in classical Qur'ānic sciences studies. Although this approach is effective in solving many problems, it does not solve all problems.The question of whether the narrators of asbâb al-nuzul is the real reason for the verse has been discussed from the very beginning. According to Ibn Taymiyya (d. 728/1328) al-Zarkashī (d. 794/1392) and al-Dihlawī (d. 1176/1762), the expression that “This verse has been revealed on this particular event” does not mean that the verse is revealed particularly and only for this event but rather that it is revealed for an event which is similar to that event, and that, subject verse also covers this provision. A. Nedim Serinsu and A. Rıza Gül also drew attention to this fact and the narratives were divided into two as the real cause of nuzul and virtual cause of nuzul. When this issue is not known, it may become inexorable to analyze and make observations, and there may be problems regarding the interlocutors, date of births, being Meccan or Medinan.Those who want to learn the first-hand meaning of the verses, their interlocutors and the environment of nuzul are facing difficulties to choose between the contradictory narrations especially in narrative-weighted commentaries. It is necessary to pay attention to some points to evaluate the narrations correctly and make the right choice. These points are prophetic biography, the stages of nuzul, information about being Meccan or Medinan, the stages of development of relations between polytheists and Muslims, and tafsīr explanations about nuzul. One of the issues with contradictory narratives and interpretations is ʿAbdallāh b. Salām. As one of the notables of the Medina Jews, he came to him when the Prophet arrived in Kuba, he asked some questions, and when he got the right answers, he became a Muslim saying that they could only be known by a prophet. It is claimed that he believed in the period of Mecca and the eighth year of the Hijr, but this information was not well accepted.Although it was not very intense in Mecca, there were certain relations between Jews and Christians and Muslims. Since there was no conflict between Muslims and the People of the Book, these verses are often praised by their scholars, and they were also cited as a reference for the Prophet and idolaters Some Meccan verses mention the following: Jews who are righteous; the fulfilment of the requirements of the book, and the prayers of the Muslims that will not be wasted; the fact that the scholars of the Israelites know the truths in the Qur'an should be a proof for the idolaters; The Ahl al-kitāb know that the Qur'ān is a divine book; if he has doubts about the verses revealed to the Prophet, he should ask the Jewish scholars; Jews witnessed and believed the truth of the prophethood of the Prophet; the fact that Ahl al-kitāb were delighted with the Qur'ān. In the exegesis of these verses, it has been commented that the interlocutors are ʿAbdallāh b. Salām and his friends, Prophet Muhammad's companions, Selman al-Fârisî, Ali and the kitāb who believed in the Prophet.Since the commentators did not consider the process experienced with the Ahl al-kitāb sufficiently, the verses that were written before becoming Muslim were associated with ʿAbdallāh b. Salām. However, Masrūk (d. 63/683), Sha'bî (d. 104/722) and Said b. Jubayr (d. 94/713 [?]) refused to relate the Meccan verses to ʿAbdallāh b. Salām because they had considered the process of nuzul. When the revelations are evaluated on the basis of the Qur'ān and prophetic biography relationship and the process of nuzul, it is understood that the interlocutors are the scholars of Ahl al-kitāb who know and acknowledge that the Qur'ān and the prophethood are right, as some commentators have indicated. In this case, it is understood that the commentators make comments that are not appropriate to the context, wording and nuzul process of the verses based on the narratives that are not true and that they use the name of ʿAbdallāh b. Salām as a kind of filling material since the information about the interlocutors is limited. It is not acceptable to praise one of them in the revelations when we evaluate the Ahl al-kitāb by generalizing the truth, their hostility towards Islam and the wars. However, there were no clashes with Jews and Christians in Mecca and there were scholars who expressed the truth. They were praised when necessary, and also cited as a reference source for the Prophet and idolaters. In addition, in the verses that criticize the Ahl al-kitāb in the verses Medinan, those who make the mistakes in question are not criticized as a whole. As in these examples, we need to evaluate the verses in the context of the individual process, not with the influence of our established perceptions and with a wholesale mind. Otherwise, unintentional results can be reached. It can be claimed that the Predecessors fell to an anachronism in their explanations about ʿAbdallāh b. Salām which did not conform to the date and time. However, when we consider the views of Ibn Taymiyya, al-Zarkashī and al-Dihlawī, it is understood that the Predecessors expressed views in terms of exegesis, opinion-based sampling rather than an anachronism. These interpretations of the Predecessors also depict that the information available to the interlocutors of the verses is insufficient. The fact that the historical information errors in Predecessors’ illustrations and explanations show that the information transferred from them should be examined carefully and that one must not surrender him/her without investigation. It is a clear fact that those who accept interpretations based on ijtihâd as an actual asbâb al-nuzul fall into anachronism. In this respect, it is understood that asbâb al-nuzul narrations should be evaluated in accordance with the principles mentioned and it is necessary to distinguish between those who tell the real reason and those who do not and make a preference among them. In this paper we study a notion of HL-extension for a structure in a finite relational language $\mathcal {L}$. We give a description of all finite minimal HL-extensions of a given finite $\mathcal {L}$ -structure. In addition, we study a group-theoretic property considered by Herwig–Lascar and show that it is closed under taking free products. We also introduce notions of coherent extensions and ultraextensive $\mathcal {L}$ -structures and show that every countable $\mathcal {L}$ -structure can be extended to a countable (...) ultraextensive structure. Finally, it follows from our results that the automorphism group of any countable ultraextensive $\mathcal {L}$ -structure has a dense locally finite subgroup. (shrink)

Radiography images are widely utilized in the health sector to recognize the patient health condition. The noise and irrelevant region information minimize the entire disease detection accuracy and computation complexity. Therefore, in this study, statistical Kolmogorov–Smirnov test has been integrated with wavelet transform to overcome the de-noising issues. Then the cat swarm-optimized deep belief network is applied to extract the features from the affected region. The optimized deep learning model reduces the feature training cost and time and improves the overall (...) disease detection accuracy. The network learning process is enhanced according to the AdaDelta learning process, which replaces the learning parameter with a delta value. This process minimizes the error rate while recognizing the disease. The efficiency of the system evaluated using image retrieval in medical application dataset. The Resource-Based View (RBV) has been instrumental in shaping strategic management theory by underscoring the significance of a firm's unique, valuable, and hard-to-copy internal resources in securing competitive advantage. However, the conventional RBV framework, with its emphasis on static, possession-oriented resource conceptualization, falls short in addressing the dynamic and relational nature of resources in contemporary business environments. This paper aims to bridge this gap by introducing a processual perspective to the RBV, grounded in process philosophy. In this study, we delve (...) into the philosophical underpinnings of RBV, critiquing its static ontological assumptions and proposing a shift towards a more dynamic and relational ontology. Drawing from the insights of process philosophers such as Whitehead and Bergson, and differentiating between 'strong' and 'weak' process views, we reconceptualize resources not as static entities, but as dynamic elements continually constituted and reconstituted within networks of relationships and ongoing organizational processes. This approach allows for a more nuanced understanding of resources, recognizing their evolutionary and interconnected nature. Our methodology involves a rigorous theoretical analysis and synthesis of existing RBV literature, coupled with philosophical inquiry to construct a novel framework for resource conceptualization. We demonstrate how this reconceptualization offers fresh insights into strategic management, particularly in formulating strategies that leverage the dynamic interplay of resources and in understanding the boundary between internal and external resources. This paper contributes to the RBV literature by offering a process-oriented perspective that aligns more closely with the complexities of modern strategic landscapes. By challenging and extending traditional RBV assumptions, we pave the way for future empirical research and theoretical development in strategic management, highlighting the significance of process philosophy in enriching management theories. Partial/particular will (al-irādah al-juz’iyyah) and the creation of human acts are two issues related to the predestination belief. Nowadays, it is unarguably accepted that humans have volition. However, the controversy over the formation steps of human will and act does not seem to be settled. Māturīdīs’ approach, taken with the intent to allow some space for freedom for humans in their actions and based on the partial will and postulation that there is a part in human actions that are not (...) created nor subject to creation, could not be understood at times. When it comes to misunderstandings of this kind, Sadr al-Sharī‘a and Ibn al-Humām, who are among the Hanafī-Māturīdī kalam scholars, are mentioned. Both mutakallims are some of the eminent figures who left their marks on the Hanafī-Māturīdī school. They affected a significant number of scholars coming after them by the authentic ideas they presented. However, even though neither Sadr al-Sharī‘a nor Ibn al-Humām did regard humans as creators of their own actions, they are confronted with an accusation as if they vitiated the fact that God is the Absolute Creator. Therefore, it is of grave importance to reveal Sadr al-Sharī‘a’s ideas, which are represented in his “Four Premises” concerning the formation of an act and Ibn Humām’s thoughts put forward in his “Ījādu al-‘Azm al-Musammamah” and “Takhsīsu Irādah al-Juz’iyyah.”. The potential of the soil to hold plant nutrients is governed by the cation-exchange capacity of any soil. Estimating soil CEC aids in conventional soil management practices to replenish the soil solution that supports plant growth. In this study, a multiple model integration scheme supervised with a hybrid genetic algorithm-neural network was developed and employed to predict the accuracy of soil CEC in Tabriz plain, an arid region of Iran. The standalone models and extreme learning machine ) were implemented for (...) incorporation into the MM-GANN. In addition, it was tested to enhance the prediction accuracy of the standalone models. The soil parameters such as clay, silt, pH, carbonate calcium equivalent, and soil organic matter were used as model inputs to predict soil CEC. With the use of several evaluation criteria, the results showed that the MM-GANN model involving the predictions of ELM and ANN models calibrated by considering all the soil parameters as inputs provided superior soil CEC estimates with a Nash Sutcliffe Efficiency = 0.87, Root Mean Square Error = 2.885, Mean Absolute Error = 2.249, Mean Absolute Percentage Error = 12.072, and coefficient of determination = 0.884. The proposed MM-GANN model is a reliable intelligence-based approach for the assessment of soil quality parameters intended for sustainability and management prospects. (shrink)

Toward the end of Light in August, in the climactic scene in Chapter 1 where the authorities of justice pursue the elusive Joe Christmas through the streets of Jefferson, William Faulkner introduces a new character, Percy Grimm, a twenty-five-year-old captain in the State National Guard who has relentlessly acquired the rank of a special deputy for the search. As the town closes for the weekend, Grimm keeps vigil at a downtown store where other townsfolk have begun a poker game to (...) stay awake through the night as the search goes on. In their zeal to uphold law and justice, his men revel in their fantastic make-believe that they are doing the work of “a hidden and unsleeping and omnipotent eye watching the doings of men.” The poker game goes on through Saturday night until Christmas is spotted and given chase. As Grimm runs through the streets after the fleeing man, Faulkner presents to us the deputy's stream of thought from an omniscient point of view: “There was nothing vengeful about him either, no fury, no outrage. He was moving again almost before he had stopped, with that lean, swift, blind obedience to whatever Player moved him on the Board” (437). Through the rest of the chapter, Grimm, who has not participated in the poker game at all, thinks and acts as if he is engaged in a chess game, not as a player but as the stake or the pawn in a board game in which Jefferson is the board on which he and Christmas are being moved from place to place by two larger forces, he by the benevolent Providence and Christmas by the powers opposed to God. Finally, when Christmas is cornered and fatally shot in Reverend Hightower's kitchen, this fantasized game seems to end. (shrink)

This chapter aims to discuss critically the changing values in higher education within the context of culturally, ethnically and religiously plural modern European societies with a special focus on the case of emerging European Islamic higher education institutions. The inquiry argues for the need to rethink the core values in Islamic and western liberal, secular higher education in order to facilitate a new creative engagement between these two distinctive perspectives on higher education that share an intertwined intellectual legacy. The focus (...) of the study is framed by the following questions: Do central educational values of Islam and western secular higher education remain in conflict? To what extent can a critical dialogue of convergence be facilitated between the educational/pedagogic cultures of Islamic and western higher education? Why should such a critical engagement be based on a shared relational ethics of respecting the dignity of difference and recognition of mutual interdependence? The study adopts a phenomenology- infomed critical, comparative analysis method while exploring the topic within its historical and contempoaray dimensiosns. The original contribution of the inquiry lies in its reflective engagement with the Islamic and western values of higher education and developing a distinctive conceptual framework to facilitate a new pedagogic dialogue among the communities of learners and teachers coming from these educational cultures who increasingly share the same social space. After presenting the aims and context of the inquiry, a brief historical account of Islamic and western values of higher education will be provided. This will be followed by discussing the arguments supporting the incompatibility of Islamic and western values of education. The incompatibility thesis will be deconstructed by critically examining its logic of binary literalism. By drawing on the evidence suggesting presence of a shared reflective, critical educational heritage between Islam and the West, the chapter argues for the need to revive these forgotten traditions of pedagogic curiosity and critical openness to inspire a new cross-pollinating dialogue capable of acknowledging the dignity of being different and recognizing the reality of sharing an interdependent world. Kur’ân-ı Kerim İslam şeriatının ilk kaynağı olduğundan dolayı geçmiş ve günümüz alimleri kendisiyle alakalı olan tefsir, kırâat, dil bilimi, i’râb ve benzeri ilimlere ehemmiyet vermişlerdir. Biz de bu çalışmamızda çeşitli islami ilimler hakkında ilim ehli zatlar arasındaki yüksek mevkii bulunan İmam Ebû Muhammed Mekkî b. Ebî Talib’i ele aldık. Kırâat, (...) tecvid, arapça, fıkıh, kelam vb. İslami ilimlerde yüze yakın eser telif eden Mekki, İslami ilimlerin çoğunu elde ederek, özellikle Kırâat ve tefsir ilmine öncülük etmiş nadir âlimlerden biridir. Biz bu çalışmamızda Mekkî b. Ebî Talib’in Kırâat ilmindeki yeri ve bu ilme katkısını ele aldık. Bunun yanı sıra onun bu alanda telif ettiği eserler ve bu eserlerin önemi üzerinde durup, özellikle kendisinin Kırâatteki Tevatür meselesine değindik. Çünkü araştırmacılar Mekkî’nin bu konudaki görüşü hakkında ihtilafa düşüp farklı fikirler öne sürmüşlerdir. Son olarak çalışmamızı Mekki b. Financial literacy has gained much attention amongst scholars, policymakers and other stakeholders due to its role in backing up investment decisions, improving personal financial management and increasing financial wellbeing. This study examines the influence of financial literacy on investment decisions with the moderating effect of the overconfidence behavioural bias. Data were collected from 180 respondents in Saudi Arabia using a questionnaire, and a convenience sampling technique was applied. The study’s findings were analysed using the partial least squares structural equation modelling (...) technique. It was found that financial literacy positively and significantly influenced investment decisions. Moreover, the results show that overconfidence positively affected investment decisions and that the relationship between financial literacy and investment decisions was positively and significantly moderated by overconfidence. Every civilized society treasures through its folk tales and folk myths the elements of its native tribal life as points of cultural reference. The tribe not only acts as a foil to our culture, but also sustains its very being and gauges the degree of progress and change in the civilization that we uphold. This interdependence has a vital force: insofar as civilized societies define themselves by the distance they have built up between themselves and their respective primitive societies, a (...) civilized culture without its indigenous tribal past risks the authenticity of its process of change to challenge and doubt. Hence, our adulation of distance in both time and space between ourselves and our tribal forefathers, and our eagerness to recognize, maintain, and even glorify our tribes—a necessary syllogism in our postulation of a self-preserving argument. In a peculiarly chiastic way, we thrive on our existential reliance on the very primitiveness that we seek to repudiate as characteristic of a world past. We celebrate our present by eulogizing our past, and to fit the tribes in the large scheme of our self-definition we iconize them. These idealized images hide a creative mask through which we embrace the romantic myths of our respective origins and progress; the parades we arrange for our tribal history—through performance on our streets, or through semantics in our literature—subtly embody this dependence. Many healthcare goods, such as surgical instruments, textiles and gloves, are manufactured in unregulated factories and sweatshops where, amongst other labour rights violations, workers are subject to considerable occupational health risks. In this paper we undertake an ethical analysis of the supply of sweatshop-produced surgical goods to healthcare providers, with a specific focus on the National Health Service of the United Kingdom. We contend that while labour abuses and occupational health deficiencies are morally unacceptable in the production of any commodity, (...) an additional wrong is incurred when the health of certain populations is secured in ways that endanger the health and well-being of people working and living elsewhere. While some measures have been taken to better regulate the supply chain to healthcare providers in the UK, further action is needed to ensure that surgical goods are sourced from suppliers who protect the labour and occupational health rights of their workers. Before the popularization of the printing press, the circula­tion of commentarial texts across regional borders, especially of Islamic texts outside of the Middle East, remains largely unexplored. This article focuses on the movement of Islamic manuscripts in the Indian Ocean world, from South and East Africa to South and East Asia. Together with merchants, sail­ors, travelers, and commodities, the books also traveled long distances, replete with ideas, stories, dreams, myths, norms, manners, and emotions. What was the role of manuscripts in (...) the expansion of Islam into the premodern oceanic world and in religio-cultural exchanges between central Islamic lands and the larger world? What sorts of books did people access, read, and use, and what did the circulation of these texts imply? I address these questions with a broad focus on the oceanic littoral and Islamic manuscripts and a specific focus on one of the ports and a legal commentary. Based on this analytical exercise of zooming-out and zooming-in between macro- and micro-maritime textual histories anchored in the sixteenth century, I argue that the citations of specific manuscripts reveal the prominence of a transregional circula­tion of certain texts, along with their contextual cultures of reading, writing, producing, and circulating commentaries. al-Qurṭubī (d. 671/1273) was a scholar of tafsīr, ḥadīth and fiqh. He experienced both Western and Eastern civilizations in the geography of Andalusia and Egypt, respectively. In his famous Tafsīr called al-Jâmi li-Aḥkâm al-Qur’ān, al-Qurṭubī comparatively explained and interpreted all legal verses. Also, in addition to exploring the spesific legal rulings denoted in the Qur’ān and the Sunnah, al-Qurṭubī has largely interpreted the legal norms regarding the issues of jurisprudence. By doing this, al-Qurṭubī contributed to the formation and development of (...) a civil codification activity under a kazuistic format. The casuistic structure of the legal exegesis of the Qur’ān is anlaysed in terms of the form and content in the sample of al-Jâmi. Therefore, neither the similarity or similarity of the schools of the legal exegesis of Qur’ān and of the legal schools nor the disciplines of positive law, but their kazuistic structures, which systems they built and which interpretation methods and techniques they operated on this basis, were evaluated in terms of their original structure. In this direction, the article emphasizes that the casuistic structure of the legal exegesis of Qur’ān is established on and by the Prophet’s sayings and practices. Although, it has been observed that it is a unique tradition, both as form and content, and that the interpretation means are identified with its own unique structure, it has been concluded that the casuistic method is not one of the fundamental elements of both this tradition and Islamic legal thought. This means that the casuistic method is always a tool that can be changed and transformed according to the conditions of time and space.Summary: As it is stated in al-Isrāʾ 17/106: “And (it is) a Qur’ān which we have separated (by intervals) that you might recite it to the people over a prolonged period. And we have sent it down progressive.”, the Qur’ān is revelaed in about twenty-three years by taking into consideration the sociocultural positions of its interlocutors. The Prophet Muḥammad explained the Qur’ān by the virtue of the ayah: “(We sent them) with clear proofs and written ordinances. And We revealed to you the message (i.e. that you may make clear to the people what was sent down to them and that they might give thought.” (an-Naḥl 16/44). Of course, there is no subject integrity in this Qurānic chronology-which also reflects life. As a matter of fact, the issues related to individual and society have been independently analyzed by a casuistic/case-based method and ruled in accordance with the intention of Allāh. It can be seen that the ayahs “They ask you about wine and gambling. Say, ‘In them is great sin and (yet, some) benefit for people. But their sin is greater than their benefit.’ And they ask you what they should spend. Say, ‘The excess (beyond needs).’ Thus Allāh makes clear to you the verses (of revelation) that you might give thought.” (al-Baqara 2/219) and other ayahs such as (al-Baqara 2/186; al-Nisāʾ 4/176; al-Anfāl 8/1) reflect the casuistic method in terms of form and content. This can also be exemplified by the Sunna. For example, when the question “Is it permissible to perform ablutions with sea water?” was posed to Messenger of Allāh. He said that “It’s water is clean and his dead (fish) are lawful “(Abū Dāwūd, “Ṭaḥāra”, 41). By this answer, the Prophet Muḥammad indeed ruled and established a general rule.It can be said that this early example table formed the basis of the legal exegesis of the Qur’ān in terms of origin, source and application, and that its shape and content are often immanent in the examples it contains. In this article, based on the prophetic period, the legal exegesis of the Qur’ān and casuistic structure has been studied with an analytical and critical approach. Again, because the casuistic method is one of the universal concepts of east-west science and cultural life, an interdisciplinary approach was exhibited in this study. The roots of the casuistic method date back to 5000 BC and the legal systems of the society and states of antiquity are examined from this method. This method is chosen and used in the legal exegesis of the Qur’ān. However, this study does not analyse the sameness or the similarity of the legal exegesis of the Qur’ān and the legal schools nor the positive law disciplines, but the casuistic structures used by these, the systems they have built on this basis and the interpretation methods and techniques they have been used and analyzed in terms of their originality.In effect, the article embodies the Qur’ānic exegesis called al-Jâmi li-Aḥkâm al-Qur’ān by al-Qurṭubī (d. 671/1273), a scholar of tafsīr, ḥadīth and fiqh. In addition to the works of the aḥkām al-Qur’āns, which deal with the interpretation of the ayahs related to the subjects of ʿibādāt, muʿāmalāt ve ʿuḳūbāt, many other works have been used in parallel with the development of the legal exegesis of the Qur’ān. al-Qurṭubī, who comparingly explained the legal verses in his tafsīr, investigated the aspects of the Qur’ān and Sunna that indicate the aḥkām, generally interpreted the existing legal norms within the framework of evidence and introduced his own opinions and etasblished his ijtihād. Thus, he benefited from the tafsīr accumulation and contributed to the formation and development of a civil legalization activity with casuistic format. As a matter of fact, the casuistic/case-based method has been used as a codification/tadwīn technique by Western and Eastern legal disciplines and systems. The casuistic method covers both concrete event and abstract ruling methods. In the casuistic method, which is fact-based event, the laws are organized according to all possible events that can be experienced. On the other hand, the abstract method, which is defined as the abstract ruling method, aims to organize the laws in a general and abstract framework. In the article, it is stated that the legal exegesis of the Qur’ān contains both concrete and abstract dimensions in its own way. It has been emphasized that the legal exegesis of the Qur’ān is based on divine revelation (waḥy) and that it is separated from human law as its origin and source, and that this feature is its most faithful characteristic. On this basis, the legal exegesis of the Qur’ān is a separate scholarly tradition and has its own definition, subject and purpose. Its original structure and function have been noted. As a matter of fact, the subject and purpose of the legal exegesis of the Qur’ān always require the tafsīr and taʾwīl of the legal verses having regard to the Qur’ān and Sunna. It is also necessary for the purpose of investigating the ways in which nuṣūṣ (an explicit statement upon which a ruling is based) can refer to the provisions and to resolve the issues related to individuals and society. As a matter of fact, the legal verses function as a guide for humanity until the day of judgment as the inspiration for religious-legal matters; they contain the content and provisions that offer happiness in the two worlds. Aversion towards logic is a characteristic feature of the Islamic traditionalists. There is in fact a history of opposition to logic in Islam. As any other areas of history, here also the correct picture will not be achieved unless all of the pieces are put together. In what follows, I am going to shed light on a chapter written by Zayn al-Dīn al-ʿĀmilī (d. 966/1558), the Twelver Shīʿī Scholar better known as al-Shahīd al-Thānī. The chapter not only shows al-Shahīd al-Thānī’s (...) negative stance towards logic, but also is important because it is a part of less studied Shīʿite traditionalists’ tendencies towards logic; those who are considered as the most influential figures in Iranian seminaries from the Safavid period up until today. For the safe and economical construction of embankment dams, the mechanical behaviour of the rockfill materials used in the dam’s shell must be analyzed. The characterization of rockfill materials with specified shear strength is difficult and expensive due to the presence of particles greater than 500 mm in diameter. This work investigates the feasibility of using an extreme gradient boosting computing paradigm to estimate the shear strength of rockfill materials. To train and validate the proposed XGBoost model, a total of (...) 165 databases obtained from the literature are chosen. The XGBoost model was compared against support vector machine, adaptive boosting, random forest, and K-nearest neighbor models described in the literature. XGBoost beats SVM, RF, AdaBoost, and KNN models in terms of performance evaluation metrics such as coefficient of determination, Nash–Sutcliffe coefficient, and error in the root mean square ratio to the standard deviation of the measured data. The results demonstrated that the XGBoost model has the highest prediction performance with, followed by the SVM model with, RF, the AdaBoost model with and the KNN model with. A sensitivity analysis has been conducted to ascertain the impact of each investigated input parameter. This study demonstrates that the established XGBoost model for estimating the shear strength of rockfill materials is reliable. (shrink)

The purpose of this study is to find empirical evidence on whether work from home or residential emissions reduces office emissions. Based on existing research the study supports that there are short-term effects on office emissions, i.e., carbon emissions do not outshine the long-term effects. The shift from offices to working from home due to COVID-19 regulations meant more people operating from home as maintaining their position in the market was crucial. The potential research area is to understand how this (...) would affect energy usage and carbon emissions. This study has used a before and after mixed approach to collect data from 301 working-from-home employees and 348 top managers who are responsible for monitoring the employees in a work from home setting. Convenience sampling helped collect responses in a timely manner as offices were not allowing visitors and collecting data in person was difficult, so online surveys were conducted. Work from home reduced usage of office equipment, transportation, pollution, etc. The air quality improved considerably but our findings show that the low emissions were only short-lived. This was not a long-term scenario as organizations kept practicing their operations even at home and the emissions stayed in the environment. Future suggestions and implications are also provided. The results give new insights to researchers in the field of sustainability and the environment. (shrink)

Timetabling problems are specific types of scheduling problems that deal with assigning certain events to the timeslots. This assigning is subject to certain hard constraints that should be achieved to get a feasible timetable and soft constraints that must meet as many as possible during forming a feasible schedule. This paper introduces an adaptive tabu search. Eleven benchmark datasets of the year 2002 are applied to show the effectiveness of the introduced algorithm. These datasets consist of 5-small, 5-medium, and 1-large (...) dataset. As compared to other methods from previous works, the proposed algorithm produces excellent timetables, in comparison with the algorithms as well as the current results, the mathematical results showed the high effectiveness of the suggested algorithm. It has a minor deficit on the medium or the small problem adaptive Tabu, and the tabu search relies on the tabu list and penalty cost when the change in the penalty cost is checked; if it is still unchanged for the period of iterations (1,000 iterations), the tabu list reduces automatically by (−2); furthermore, the tabu list remains constant. A Preliminary Critique of the Report of the Truth and Reconciliation Commission of South Africa (TRC) Mahmood Mamdani The Truth and Reconciliation Commission of South Africa was the fruit of a political compromise whose terms both made possible the Commission and set the limits within which it would work. These limits, in turn, defined the space available (...) to the Commission to interpret its terms of reference and define its agenda. This paper takes the compromise legislation that set up the TRC as a historical given and focuses attention on the TRC's interpretation of its terms of reference.The TRC claimed to be different from its predecessors, whether in Latin America or Eastern Europe. It would practice neither impunity nor vengeance. It was therefore determined to avoid two pitfalls: on the one hand, reconciliation becoming an unprincipled embrace of political evil and, on the other hand, a pursuit of justice so relentless as to turn into revenge. To do so, the Commission was determined to address both "victims" and "perpetrators," not just one or the other.This double determination was first written into the interim constitution that paved the way for the legislation that set up the TRC. First, there would be no blanket amnesty. Amnesty would be conditional. It would not be a group amnesty. Every perpetrator would have to be identified individually, and would have to own up to his or her guilt—the truth—before receiving amnesty from legal prosecution. Second, any victim who is so acknowledged would give up the right to prosecute perpetrators in courts of law. Justice for the victim would thus not be criminal but restorative: acknowledgment would be followed by reparations. In sum, individual amnesty for the perpetrator, truth for the society, and acknowledgement and reparations for the victim—this was the pact built into the legislation that set up the TRC.Since the Act did not clearly define "victim," however, the definition of "perpetrator" was unclear as well. The task of defining "victim" and "perpetrator" was left to the Commission and was the single most important decision that determined the scope and depth of the Commission's work. Without a comprehensive acknowledgment of victims of apartheid, there would be only a limited identification of perpetrators and only a partial understanding of the legal regime that made possible the "crime against humanity." From this perspective, the paper identifies three key limitations in the Commission's Report.First, the TRC individualized the victims of apartheid. Though it acknowledged apartheid as a "crime against humanity" which targeted entire communities for ethnic and racial policing and cleansing, the Commission majority was reluctant to go beyond the formal acknowledgment. The Commission's analysis reduced apartheid from a relationship between the state and entire communities to one between the state and [End Page 33] individuals. Where entire communities were victims of gross violations of rights, the Commission acknowledged only individual victims. If the "crime against humanity" involved a targeting of entire communities for racial and ethnic cleansing and policing, individualizing the victim obliterated this particular—many would argue central—characteristic of apartheid. Limiting the definition of harm and remedy to individuals center-staged political activists as victims of apartheid, as indeed happened with the victim hearings. The consequence was to narrow the TRC perspective to a political reconciliation between state agents and political activists, individual members of a fractured political elite, rather than the "national unity and reconciliation" mandated by the legislation that set it up. To pursue its actual mandate, the TRC needed to broaden its perspective: to work for a social reconciliation between perpetrators and victims required that the relationship between the state and the entire South African people be addressed.Second, by focusing on individuals and obscuring the victimization of communities, the TRC was unable to highlight the bifurcated nature of apartheid as a form of power that governed natives differently from non-natives. We examined the direct and indirect (via relational social capital) relationship between ethical leadership and knowledge hiding. We also tested the moderating role of instrumental thinking in the relationship between ethical leadership and knowledge hiding and the relationship between ethical leadership and relational social capital. Data were collected from 245 employees in different firms spanning different manufacturing and service sectors. The results showed that ethical leadership was negatively related to knowledge hiding, both directly and via relational social capital. The results (...) revealed that instrumental thinking moderated the positive relationship between ethical leadership and relational social capital, such that the relationship was weak when instrumental thinking was high. The turn to descriptive studies of ethics is inspired by the sense that our ethical theorizing needs to engage ethnography, history, and literature in order to address the full complexity of ethical life. This article examines four books that describe the cultivation of virtue in diverse cultural contexts, two concerning early China and two concerning Islam in recent years. All four emphasize the significance of embodiment, and they attend to the complex ways in which choice and agency interact with the (...) authority of tradition. In considering these books, this article examines the relations between our academic claims concerning the self and ethics, conceptual or theoretical claims made in the elite writings of traditions, and the lived experiences of the people we study. The conclusion turns to our methodological foundations for studying these topics both comparatively and constructively. (shrink)
